Who regulates fall protection in New York

For private employers, federal OSHA sets and enforces fall protection, because New York's State Plan (the PESH program) covers public employees only. So a private contractor in New York follows the federal standards: fall protection at 6 feet in construction and 4 feet in general industry. On top of that, New York State law adds some of the strongest elevation-safety obligations in the country, and large cities add their own requirements (see below).

New York State elevation laws (beyond OSHA)

The Scaffold Law is the single most important thing to know about height work in New York. Labor Law §240 places strict liability on property owners and general contractors for gravity-related injuries, including falls from height and being struck by falling objects, when proper protection was not provided, even if the worker was partly at fault.

Industrial Code Rule 23: the sections inspectors and courts cite

Industrial Code Rule 23 (12 NYCRR Part 23) is New York's own construction safety code, and it matters for a reason OSHA does not: a violation of a specific ICR 23 section is the foundation of a Labor Law §241(6) claim. These are the fall protection sections that come up on real New York projects.

Equipment and anchorage requirements

Because private-sector New York follows federal OSHA, fall protection equipment must meet the federal standards in 29 CFR 1926 Subpart M and 1910. The core requirements:

Reporting a serious injury or death

In a medical emergency, call 911 first. Private employers report work-related fatalities and severe injuries to federal OSHA: a fatality within 8 hours, and an in-patient hospitalization, amputation, or loss of an eye within 24 hours, at 1-800-321-6742. Public employers report to the NY PESH program.

Penalties

Federal OSHA fall protection violations carry a 2025 maximum of $16,550 for serious and $165,514 for willful or repeat violations. Beyond OSHA fines, New York's Scaffold Law exposes owners and GCs to civil liability for elevation injuries, and city agencies (such as NYC DOB) impose their own penalties and stop-work orders.

Fall fatalities in New York

24 of 55

In 2024, falls, slips, and trips caused 24 of New York's 55 construction and extraction fatalities, and the construction sector recorded 50 deaths. Additional requirements in New York's larger cities

Some New York cities layer their own construction-safety rules on top of state and federal requirements. If your job is in one of these cities, you must meet these in addition to everything above.

New York City

NYC Department of Buildings (DOB)

New York City imposes the most extensive city-level construction-safety rules in the country. If your job is in the five boroughs, you must meet all of the following in addition to federal OSHA and New York State law.

Site Safety Training (SST) cards, Local Law 196

Most workers and supervisors at permitted construction sites must complete Site Safety Training and carry an SST card on site. Fall protection is a required part of the curriculum.

Cards are issued through DOB-approved providers, must be physically carried on site, and renew on a five-year cycle with annual continuing-education hours. Verification on entry is mandatory, and penalties can fall on every party that allows an un-carded worker on site, including the employer and the permit holder (SST penalties are commonly cited at up to $5,000 per untrained worker).

DOB site safety framework

Depending on building size and height, projects may need a written site safety plan, a licensed Site Safety Manager or Site Safety Coordinator, and a Construction Superintendent. Under Building Code Chapter 33 (BC 3314), suspended scaffolds require a permit and installation under a licensed rigger, and many must be designed by a registered design professional; suspended and supported scaffold users must hold the applicable DOB user training. Facade work is governed by the Facade Inspection Safety Program (FISP, Local Law 11).

NYC reporting and contacts

Fall protection regulation questions, answered

At what height does OSHA require fall protection in construction?
Six feet above a lower level, under 29 CFR 1926.501(b)(1). General industry workplaces trigger at 4 feet under 1910.28, shipyards at 5 feet, and longshoring at 8 feet. Two common construction exceptions: scaffolds trigger at 10 feet under Subpart L, and fixed ladders require protection when the climb reaches 24 feet. Working above dangerous equipment requires protection at any height.
Is there a rule that lets me skip fall protection if I stay 6 feet from the edge?
No. Federal OSHA has no safe-distance exemption for construction work. Six feet is the height that triggers the duty, not a buffer zone on the roof. The closest thing in the standard is the warning line system for low-slope roofing work under 1926.502(f), which must be rigged at least 6 feet from the edge (10 feet when mechanical equipment is in use) and only works in the specific combinations 1926.501(b)(10) allows.
Do I need fall protection on a residential roof?
Yes. Under 1926.501(b)(13), anyone doing residential construction 6 feet or more above a lower level needs guardrails, safety nets, or a personal fall arrest system. If the employer can demonstrate those are infeasible or create a greater hazard, the only alternative is a written, site-specific fall protection plan that meets every requirement of 1926.502(k), which includes a qualified person preparing it and a competent person supervising it.
What does OSHA require for an anchor point?
An anchorage for personal fall arrest must support at least 5,000 pounds per worker attached, or be designed, installed, and used under the supervision of a qualified person as part of a complete system that maintains a safety factor of at least two. That is 1926.502(d)(15). Anchorages must also be independent of any anchorage used to support or suspend platforms.
How high does a guardrail have to be?
The top rail must be 42 inches above the walking or working level, plus or minus 3 inches, and it must withstand 200 pounds of outward or downward force under 1926.502(b). Midrails go at 21 inches and must take 150 pounds. When guardrails protect a hole, they go on all unprotected sides, and any gate or removable section has its own rules in the same paragraph.
What is the difference between a competent person and a qualified person?
A competent person can identify existing and predictable hazards and has the employer's authority to promptly correct them, which includes stopping work. A qualified person has a degree, certificate, or extensive experience that lets them solve problems relating to the work, such as engineering an anchorage below 5,000 pounds. Subpart M assigns specific duties to each: for example, training under 1926.503 requires a competent person, and a fall protection plan under 1926.502(k) must be prepared by a qualified person.
Are the ANSI Z359 standards part of these regulations?
Not directly. OSHA regulations are federal law and free to read; ANSI Z359 is a voluntary consensus standard that manufacturers certify equipment against, and its text is copyrighted.
